Kadenzo Terms of Service

1. Acceptance of Terms

By accessing and using Kadenzo("the Service"), you agree to be bound by these Terms. If you do not agree, please discontinue use.

2. Service Description

Kadenzo is a web application that allows users to connect their social media accounts, schedule and publish posts, manage content across multiple platforms, and view analytics. It is provided from the Czech Republic, in English, to business and consumer customers worldwide.

We also publish free tools and guides on kadenzo.app, which anyone may use without an account. Section 6 covers those.

2a. The Free Tools on kadenzo.app

The tools are offered free of charge, as they are, for your own use. Some run entirely in your browser and never send your files to us; others send your text to an AI provider to generate a result. Our Privacy Policy says which is which.

• You keep what you put in and what comes out. We claim no ownership of your input or of the output a tool produces, and you may use the output commercially.
• Only use your own material. You are responsible for having the rights to any text, image, audio, or video you submit.
• AI output needs checking. Generated text can be wrong, generic, or unintentionally similar to something else. Read it before you publish it — you are responsible for what you post.
• Fair use.The tools are rate limited. Don't script, scrape, or resell them, and don't use them to produce unlawful or infringing content.
• No guarantee of availability. Free tools may change or be withdrawn at any time.

3. User Accounts

To access certain features, you must register an account. You agree to:

• Provide accurate and complete registration information
• Maintain the confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us of any unauthorized use immediately

4. Social Media Integration

By connecting your accounts, you grant Kadenzo permission to:

• Access your connected accounts for scheduling, publishing, and analytics
• Act on your behalf only to the extent necessary to provide the Service

You remain fully responsible for the content you create and post. You must comply with the terms of each connected platform (e.g., Meta, X/Twitter, LinkedIn, YouTube, TikTok, Pinterest). You may revoke access at any time through your account settings or directly via the platform.

Meta Platforms Specific Requirements:

• You must comply with Meta's Platform Terms and Community Standards
• You understand Meta may revoke access permissions at any time
• You agree to Meta's data handling and privacy practices

5. Content Guidelines

You agree not to post content through the Service that:

• Violates any law or regulation
• Infringes intellectual property rights
• Contains hate speech, harassment, or discriminatory content
• Includes spam or misleading information
• Violates the policies of the connected platform
• Distributes malware or harmful content
• Impersonates any person or entity
• Circumvents platform rate limits or restrictions

6. Subscriptions & Payments

• Kadenzo offers subscription plans with monthly or annual billing. Current prices are shown on our pricing page and are stated in US dollars
• Payments are securely processed by Stripe
• The 7-day trial costs $1. When you start a trial we take a single $1 activation charge immediately, which verifies your payment card. That is the only amount charged during the trial
• The trial converts automatically. At the end of the 7 days, your subscription begins and your card is charged the full price of the plan you chose, unless you cancel before then. It then renews automatically each billing period
• You may cancel at any time in your dashboard, including during the trial. Cancelling during the trial means you are never charged beyond the $1; cancelling later takes effect at the end of the billing cycle you have paid for
• Price changes will be notified with 30 days notice

7. Refund Policy

• Paid subscriptions include a 14-day money-back guarantee on your first plan charge — the payment taken when the trial converts. Ask within 14 days of that charge and we refund it in full
• The $1 trial activation charge is not refunded, as it exists to verify the card. Cancel during the trial and you pay nothing further
• Refund requests must be sent to jan@kadenzo.app

7a. Right of Withdrawal (EU Consumers)

If you are a consumer resident in the European Union, you have a statutory right to withdraw from this contract within 14 days of it being concluded, without giving any reason. To withdraw, simply tell us — an email to jan@kadenzo.app saying so is enough. We will refund all payments received from you within 14 days of being informed.

Important, because you get access immediately: by starting your trial and using the Service straight away, you expressly request that we begin performance during the withdrawal period, and you acknowledge that you lose your right of withdrawal once the Service has been fully performed. Where we have begun but not completed performance, you may still withdraw and pay only a proportionate amount for what you used.

Our 14-day money-back guarantee in section 7 sits on top of this and is often the simpler route — it applies to the first plan charge regardless of where you live or why you ask.

8. Data Privacy

We process personal and account data in accordance with our Privacy Policy, and cookies in accordance with our Cookie Policy. You retain ownership of your content and account data.

9. Termination

We may suspend or terminate your account if you violate these Terms or misuse the Service.

10. Intellectual Property

All app code, design, and branding belong to Kadenzo. You retain ownership of any content you upload or schedule.

11. Limitation of Liability

The Service is provided "as is." To the fullest extent permitted by law, Kadenzo is not liable for indirect or consequential damages, including lost profits or lost data.

12. Disclaimer

• No Guarantee of Results: Kadenzo helps schedule posts but does not guarantee engagement, growth, or revenue
• Third-Party Responsibility: Kadenzo is not responsible for outages or changes in third-party platforms (e.g., Meta, TikTok)
• No Professional Advice: Nothing in the Service constitutes legal, financial, or business advice
• We are not liable for third-party platform outages
• We don't guarantee specific results or outcomes

13. Governing Law

These Terms are governed by the laws of the Czech Republic. If you are a consumer, this does not deprive you of the protection of any mandatory consumer law of the country where you live.

Out-of-court dispute resolution. If we cannot settle a complaint between us, consumers may bring the dispute to the Czech Trade Inspection Authority, which is the competent body for out-of-court resolution:

14. Service Availability

• We strive for 99.9% uptime but don't guarantee uninterrupted service
• We may modify or discontinue features with notice
• Scheduled maintenance will be communicated in advance when possible

15. Indemnification

You agree to indemnify and hold us harmless from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your content posted through the Service

16. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or in-app notification.
